The alleged victim dragged his tour promoter into the legal mess.

This comes after the tour promoter submitted a motion to undermine some of Diaw's allegations, which he claimed ignored Brown's controversial past and fostered an environment in which the “violent artist was sure to cause harm.”

While the tour promoter said they shouldn't be on the hook for any of Brown's alleged actions, Judge Mark H. Epstein didn't see it that way.

Although Judge Epstein admitted that “the case is thin,” he emphasized that Diaw made sufficient arguments to move forward.

“The court is inclined to DENY the motion,” according to the latest documents filed Monday in Los Angeles Superior Court.

The judge denied the tour operator's request to refute some of Diaw's allegations.

“The allegations of malice and oppression are adequately alleged for plea purposes. Specifically, the plaintiff alleges that Live Nation was aware of Brown's proclivities and that he had assaulted people in the past. The Tour was dubbed the 'Under the Influence' Tour, allegedly to promote substance abuse, which prosecutors allege contributed to Brown's violent behavior,” the paperwork continued.

“The combination of the name of the tour and the alleged knowledge of Brown's prior conduct during the tour is sufficient to support a plea, although the court acknowledges that the case is thin. The court is of the opinion that the case can better be tested in summary proceedings than in a plea. phase.”

Diaw said he was taken to hospital for his alleged injuries, which reportedly included lacerations to his head and torn ligaments on his leg. Brown's alleged victim trashed his tour promoter after they tried to avoid responsibility. He argued that the singer's history of “violent attacks” is well documented, and reminded the court that his past prevented him from entering several countries.

He also argued that the tour promoter ignored the “red flags” and “continued to organize the tour,” further claiming that the company “added fuel to the fire by calling the tour the 'Under the Influence' Tour, a headline that inspires the fans. consumption of alcohol and narcotics.”

Diaw said: “It is no surprise that one night after a performance, while under the influence in a London nightclub, Brown brutally attacked the claimant (with a bottle of tequila). So despite knowledge of Brown's previous misconduct and propensity for violence, Live Nation attempted to reinforce its bad-boy persona by giving the tour a nefarious title, rather than minimizing these threats to the audience (i.e. granting Brown security, limiting his social obligations, etc.) “

The case is still ongoing.
