A Nevada judge rejected a ruling on Friday case against six fake voters who has declared himself a former president Donald Trump won the 2020 presidential election.
Clark County District Court Judge Mary Kay Holthus ruled from the bench that the state filed the case in the wrong jurisdiction, the attorney general's office confirmed to NBC News.
A spokesperson for the office said the state's top prosecutor “will immediately appeal.”
The judge's ruling comes after a grand jury indicted in December six Republicans as part of a probe to the 2020 presidential elections.
Among those charged were Nevada State Party GOP Chairman Michael McDonald and Vice Chairman and National Committeeman Jim DeGraffenreid. both of which have been previously published before a criminal grand jury investigating the Capitol riot.
Fake voter lists for the former president were also organized and charges have been filed in other battleground states such as Michigan And Georgia.
Earlier this month, three men in Wisconsin were charged in the false voter scheme to keep Trump in power.
